These Terms of Service (“Terms”) govern your access to and use of HyProbe’s website and platform (the “Service”). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using HyProbe you represent that you meet these requirements and that your use complies with all laws that apply to you.
The Service is not financial advice
HyProbe is a market-analytics and software tool. It is not a broker-dealer, investment adviser, or financial advisor, and is not registered with or licensed by any financial regulator. Nothing in the Service is investment, financial, legal, or tax advice, or a recommendation to buy or sell any instrument. You are solely responsible for your decisions. Please read our Risk Disclosure & Disclaimer, which forms part of these Terms.
Accounts
You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly of any unauthorised use. We may suspend or terminate accounts that violate these Terms.
Acceptable use
- Do not misuse, overload, or attempt to disrupt or reverse-engineer the platform.
- Do not scrape, resell, or redistribute market data or platform outputs except as permitted.
- Respect intellectual property and applicable market-data and exchange policies.
- Do not use the Service for any unlawful purpose.
Market data & third-party content
Market data and certain content are provided by third parties and are subject to their terms. Data may be delayed, incomplete, or inaccurate and is provided “as is”. Free plans use delayed data.
Subscriptions & billing
Paid plans are billed in advance on a recurring basis (monthly or annually) at the prices shown at checkout. Taxes may apply. Subscriptions renew automatically until cancelled. You can cancel at any time, effective at the end of your current billing period; unless required by law, payments are non-refundable. We may change prices or plans on reasonable notice.
Intellectual property
The Service, including its software, scenarios, models, and content, is owned by HyProbe and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, accurate, or error-free, and we do not guarantee any performance, outcome, or result. Probabilities and backtested or hypothetical results are illustrative and not a guarantee of future performance.
Limitation of liability
To the maximum extent permitted by law, HyProbe and its team will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any trading or investment losses, lost profits, or loss of data, arising from or related to your use of the Service. To the extent any liability cannot be excluded, it is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.
Changes
We may update the Service and these Terms from time to time. Material changes will be posted here with an updated date; continued use after changes take effect constitutes acceptance.
Governing law
These Terms are governed by the laws of the jurisdiction in which HyProbe is established. The specific governing law and venue for disputes will be set out here once our company incorporation is complete.
